A Texas man is prison-bound after officials say he shot an Uber driver six times in a "road rage incident."

Robert Crolley, 43, of Plano, was convicted of aggravated assault with a deadly weapon causing serious bodily injury and has been sentenced to 40 years in prison, according to an Oct. 8 news release from Collin County District Attorney Greg Willis.

McClatchy News reached out to Crolley's attorney Oct. 10 for comment but did not immediately hear back.

On March 3, 2023, shortly before 1 a.m., the Plano Police Department responded to multiple reports of gunfire, including a "distressing" call from the victim -- an Uber driver -- saying "I'm dying, I'm dying!" the district attorney's office said.

The victim, with multiple gunshot wounds, was "barely conscious" when officers arrived, officials said.

Trauma surgeons were able to revive the driver despite him losing vital signs on the way to the hospital, according to the district attorney.

He spent three months in the hospital and needs "ongoing medical care due to the severity of his injuries," officials said.

According to an arrest affidavit, the Uber driver pulled up next to an Infiniti for a few seconds before shots were fired, KDFW reported.

He had dropped off a passenger shortly before the shooting, officials said.

Authorities traced the Inifiti's license plate to Crolley, KDFW reported.

Surveillance footage and eyewitness accounts also helped police identify Crolley, according to officials.

Crolley told authorities several different stories about the events of that night, but in a phone call from jail, told his roommate he shot the victim, saying it was self-defense "after the victim pulled a gun on him," officials said.

Crolley said he "should be fine if (he) can just convince a jury," according to the release.

Officials said there was no evidence the Uber driver "ever brandished" a gun, nor would he have had the opportunity to do so, according to the district attorney's office.

Plano is about a 20-mile drive northeast from Dallas.
